Terms of Service & Booking Conditions

Throughout these Terms of Service, the following definitions apply:

• "The Platform" or "Service":Our website (kemra-travel.web.app), mobile interfaces, software applications, APIs, and associated technology tools enabling travelers to discover, search, review, and book tourism experiences.
• "User", "Traveler", or "You":Any individual, consumer, or legal representative accessing our service to browse, reserve, purchase, or review travel packages and experiences.
• "Third-Party Tour Operator" or "Service Provider":An independent, verified third-party tourism company, certified Egyptologist guide, cruise operator, transport provider, or hotel entity listing and fulfilling tourism packages via the platform. Tour operators are independent contractors and are not employees, agents, or joint-venture partners of Kemra Travel.
• "Tour Package" or "Tourism Services":The experiential travel services offered by providers, including day tours, desert safaris, Nile cruises, marine diving excursions, and multi-day bespoke travel packages.

Kemra Travel operates as a specialized Technical Marketplace & Booking Intermediary connecting global travelers with verified local tour operators. Except for explicitly demarcated platform-operated excursions, we do not organize, operate, own, or physically deliver the tours ourselves.

• Pricing & Quotations: All prices displayed on the platform are published in good faith based on provider inputs. Prices are reviewed regularly and include all standard itinerary inclusions as specified on the excursion detail page.
• Dual Confirmation Mechanism (Email & Official WhatsApp):

  A booking becomes final and contractually binding only upon issuance of our official booking confirmation. Confirmations are dispatched simultaneously via Email and official WhatsApp message to your registered mobile phone number.

  📱 Official WhatsApp Proof of Booking: Due to immediate delivery and live concierge coordination, the WhatsApp confirmation message serves as the primary and official operational proof of your reservation. Please ensure your registered phone number is accurate and accessible.
• Provider Policies & Restrictions: By booking a tour, you simultaneously agree to the specific operator rules (e.g., minimum age requirements, luggage allowances, fitness advisories, and cancellation schedules) displayed on the checkout page prior to confirmation.

We provide two flexible payment pathways tailored to your travel preference:

Provider Cancellation Rules: Cancellation and refund terms are determined by the specific tour operator. For standard day tours, free cancellation is generally permitted up to 24 hours before departure (for Pay-on-Arrival) or 48 hours (for online card payments). Bespoke Nile cruises or multi-day expeditions may have customized cancellation schedules stated on the booking voucher.

Platform Force Majeure Cancellations: In rare circumstances where a tour cannot safely proceed due to extreme weather, safety alerts, or provider incapacity, we will notify you immediately via WhatsApp and process a 100% full refund to your original payment method within 14 business days.

• Information Accuracy: You bear sole responsibility for ensuring all traveler names, contact details, passport numbers, and pickup addresses are accurate.
• Account Security: You are responsible for safeguarding your login credentials. Notify us immediately if you suspect unauthorized account access.
• Safety & Local Laws: Travelers must comply with instructions given by licensed guides and boat captains, observe safety protocols, and respect the cultural traditions and laws of the destination.

The platform, software, and booking tools are provided strictly on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind, whether express or implied.

Kemra Travel does not warrant that the service will be uninterrupted or error-free. Physical excursion fulfillment, luggage care, and marine transport are executed under the direct operational control of third-party operators and their respective maritime and tourism liability insurances.

All proprietary content, brand logos, code, software architecture, UI components, images, video reels, and editorial travel guides on the platform are the exclusive intellectual property of Kemra Travel Inc. or its licensors. Users receive a limited, revocable, non-commercial license for personal travel planning. Unauthorized copying, scraping, or commercial republication is strictly prohibited.

You agree to defend, indemnify, and hold harmless Kemra Travel Inc., its officers, directors, employees, and representatives from and against any claims, liabilities, losses, damages, and legal expenses arising out of or related to: (a) your violation of these Terms, (b) improper use of the platform, (c) violation of third-party rights, or (d) disputes between you and any tour operator.

We reserve the right to suspend or terminate your account and restrict platform access immediately without prior notice if you breach these Terms, engage in fraudulent transactions, or perform actions harmful to the platform or other travelers.

Governing Law: These Terms shall be governed by and construed in accordance with the substantive laws of the Arab Republic of Egypt, without regard to conflict of law principles.

Amicable Resolution & Arbitration: In the event of any disagreement, parties agree to first pursue amicable resolution with our Concierge Support within 7 business days. If unresolved, disputes shall be submitted to binding arbitration under the rules of commercial arbitration or the competent courts of Egypt.

We reserve the right to revise these Terms periodically. Revised versions will be published with an updated "Last Updated" timestamp. Continued use of the platform constitutes acceptance of updated terms. Existing confirmed bookings remain governed by the Terms in effect at the exact time of reservation.

• Severability: If any provision is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
• Official Notices: Official notices will be dispatched via registered email or WhatsApp message, with whichever arrives first being legally effective.
• Non-Waiver: Failure by Kemra Travel to enforce any right or provision shall not constitute a waiver of future enforcement.
• Prevailing Language: In the event of any linguistic divergence between translated versions, the English legal text shall prevail.
